Reversing..- Edward B. Distman was treasurer of tbe state for tbe term of four years beginning on tbe first Monday in January, 1924. He gave bond, with a corporate surety, in the penal sum of $300,000, conditioned “that the said Edward B. Dishman shall faithfully perform and discharge all of the duties of the office of Treasurer for the State of Kentucky.” The statute under which the bond was given provided that “for any breach thereof, action may be instituted, from time to time, and recovery had to the extent of the damages sustained by the 'Commonwealth…
