It is impossible to sustain the writ of error in this-case without overturning the law of the land, as established by the unanimous opinion of all the members of this court in the case of Raymond v. Wheeler, 9 Com-en, 295. In that case, as well as in this, the set off was claimed against one who was neither a party to the record, nor the person for whose benefit the suit was brought.
