The Chapter 7 Trustee (the “Trustee”) filed this adversary proceeding against Defendants James J. Fuld, Jr. (“Fuld”) and Connecticut Community Bank, N.A., d/b/a Greenwich Bank & Trust company (the “Bank”) (collectively the “Defendants”), seeking to recover $485,569.95 (the “Claim Amount”) as avoidance claims. Defendants have moved for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure, made applicable by Rule 7056 of the Federal Rules of Bankruptcy Procedure (the “Defendants’ Motion”).
