Jay Schmitt contends that his employer fired him while retaining younger, less qualified employees, but his claim of age discrimination foundered because a questionable litigation strategy obscured the salient issue. Schmitt focused heavily on comparing himself to a newly hired, entry-level employee whom, he argued, assumed many of his previous responsibilities.
