This is an action for a declaratory judgment. The plaintiff, American Automobile Insurance Company, which had issued a liability insurance policy to Sharpies Corporation paid a loss arising out of an accident in which Cope, an employee of Sharpies, while driving an automobile in the course of his employment caused personal injuries and property damage. Cope had a liability insurance policy with the defendant, Indemnity Insurance Company.
