Mike Zachos filed a petition in the Superior Court of Fulton County against Citizens & Southern National Bank and Mrs. Mamie Elizabeth Zachos, as executor and executrix respectively of the estate of Louis G. Zachos. By amendment, the plaintiff sought to make Mrs. Mamie Elizabeth Zachos a party defendant in her individual capacity, but no order was ever taken making her such a party, and the case proceeded against the original defendants.
