This case comes before us on a petition for a writ of habeas corpus by Carl W. Frazier against Harold Y. Langlois, Warden. The writ issued and'pursuant thereto the pertinent records have been certified to this court.

The pertinent facts are as follows. On July 2, 1964, petitioner was convicted by a jury for the unlawful sale of narcotics in violation of G. L. 1956, §21-28-32, as amended. On October 7, 1964, after his motion for a new trial had been denied, petitioner was sentenced to 10 years imprisonment by a justice of the superior court.
