Appeal from a judgment involving, among other things, an award of $5,000 to plaintiff-respondent, Alan R. Hohenstein, as repayment of a “loan” made by plaintiff to defendant-appellant, Jan R. Goergen. Originally, there were two defendants in the present case. Only Goergen is appealing.
Defendant was engaged in an investment operation in which it was proposed that mutual funds would be purchased through a limited partnership medium. By investing $2,500 in cash and obtaining a letter of credit for $25,000, an investor could acquire approximately a $100,000 interest in mutual fund shares.…
