Kendall Stockstill is a former employee of Coastline Construction, Inc., an independent contractor that supplies welding services to Shell Oil Company. In the fall of 1988 Shell informed Coastline that Stockstill would no longer be allowed on Shell facilities. Shell’s action against Stockstill stemmed from its investigation of a sexual harassment and discrimination charge filed in the summer of 1988 by B.J. Holcombe, a former employee of a Shell subsidiary. As part of its investigation into Holcombe’s charge, Shell interviewed an employee named Galen “Skipper” Berne.…
