Appeal by the defendant, Gregory Semenoff, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 14th day of April, 1922, denying his motion to vacate the order of arrest made herein.

On the 21st day of August, 1920, an involuntary petition in bankruptcy was filed against the Youroveta Home and Foreign Trade Co., Inc., in the United States District Court for the Southern District of New York, and the plaintiff and one Rosen were appointed its receivers, and thereafter and on the 28th of June, 1921, the plaintiff was duly appointed trustee and qualified, and, as such trustee, brought this action to recover over on a judg*428ment for rubles equivalent in value to $478,578, alleged to have been recovered on or about the 1st day of December, 1921, by the bankrupt…
