1. The defendant in error brought suit against the railway company in a justice’s court in Douglas county, to *244recover damages for killing a certain bay mare mule, alleging his damage to be $85. The trial resulted in a judgment for the plaintiff for $60, and the company entered an appeal to the superior court. The case was there tried, and a vei’dict rendered for the plaintiff for the sum of $65 and cost of suit. The defendant made a motion for new trial, which was overruled, and it excepted.
