This is a statutory petition for a writ of mandate, Code of Civil Procedure section 418.10, subdivision (c), 1 to compel quashing service of summons. On May 6, 1988, plaintiff and real party in interest Duvall sued petitioner and defendant, Dr. Jellinek, in the small claims court for malpractice connected with plastic surgery performed on May 7, 1987, seeking damages of $1,500. Sometime in April 1990 after the statute of limitations had run, 2 Duvall moved for a transfer to superior court, using papers prepared by an attorney, on the ground that her damages…
