Appeal from a judgment of the County Court of Rensselaer County (McGrath, J.), rendered January 24, 2001, upon a verdict convicting defendant of six counts of the crime of sexual abuse in the first degree.

Following a retrial, defendant was convicted by a jury of six counts of sexual abuse in the first degree for his conduct on specified occasions between July 1993 and February 27, 1997 in subjecting his stepdaughter — born in August 1983 — to sexual contact, either by forcible compulsion or when the victim was less than 11 years old (see Penal Law § 130.65 [1], [3]).
