ORDER GRANTING MOTIONS FOR PARTIAL SUMMARY JUDGMENT
MALONEY, District Judge.
On October 3, 1988, Defendant Atchison, Topeka & Santa Fe Railway Company (ATSF) filed its Motion for Partial Summary Judgment. On October 7,1988, Defendants Yamashita-Shinnihon Kisen K.K. (Ya-mashita) and Y.S. Line USA Corp. (Y.S. Line) filed their Motion for Partial Summary Judgment. Plaintiff has failed to file a response to either motion. Pursuant to Local Rule 5.1(e), United States District Court, Northern District of Texas, these motions are ripe for disposition.
