At the March adjourned term of the Ripley Circuit Court, 1906, the defendant was tried and found guilty of an assault with intent to kill George Rutherford, in Ripley county, on the 4th day of September, 1905. The prosecution was commenced *593by information filed' by the prosecuting attorney, and the defendant was duly arraigned and convicted by jury regularly impaneled. From his conviction he has appealed to this court.
