BARRETT, Commissioner.
Upon a charge of murder in the first degree in killing Omer (“Poor Boy”) Welch on September 5, 1955, the appellant, Raymond Bounds, has been found guilty of murder in the second degree and sentenced to twenty years’ imprisonment.
It is first urged that the court erred in overruling the appellant’s motion to quash the information for the reasons that it was not returnable to any term of the Circuit Court of Pemiscot County, was not verified by the official oath of the prosecuting attorney, and failed to charge the appellant with any offense, particularly with either first…
