Hutchison, J.:

In this case the defendant was charged with petty larceny in five counts differing only as to dates, and the trial court sustained a motion to quash the information and all the counts thereof because they failed to charge any offense against the laws of the state, and particularly because no criminal intent was alleged, and the state, under the provisions of G. S. 1935, 62-1703, appealed from that ruling.
