Appeal by the relator, Paul Ajas, from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Kings on the 24th day of June, 1904, denying the relator’s motion for a peremptory writ of mandamus.

Woodward, J.:

The relator is janitor of Public School No. 123 of the borough of Brooklyn, and he seeks a peremptory writ of mandamus to compel the board of education of the city of New York to place his name upon the payroll of the said board of education at the annual-salary of $4,633.97 per annum, it being claimed that he is entitled to this sum by reason of the provisions of section 47 of the Rules and Regulations of the School Board of- the Boroughs of Manhattan and The Bronx, which, it is claimed, constitutes the prevailing rate of wages established by the board of education for the…
