Defendant was Plaintiffs attorney, having drawn up wills for him and his wife in the 1970’s. In late 1991, Plaintiff again consulted Defendant, this time for legal advice concerning the disposition of proceeds from the sale of his family’s farm. Defendant suggested a family trust, in order to minimize taxes and help Plaintiffs brothers become eligible for Medicaid.
