OPINION

{¶ 1} Defendant-appellant Michael A. Shaffer appeals his conviction and sentence entered in the Muskingum County Court of Common Pleas.

{¶ 2} Plaintiff-appellee is the State of Ohio.

STATEMENT OF THE CASE AND FACTS

{¶ 3} On or about October 13, 2005, Patrolman Shane Patterson of the South Zanesville Police Department was parked on Maysville Avenue, in the Village of South Zanesville, Ohio, and was speaking with Deputy Ryan Paisley of the Muskingum County Sheriff's Department, who was also parked in the same parking lot.
