JONES, Chief Justice.

In a suit in a district court of Dallas county, appellee, American Surety Company of New York, obtained a judgment in the principal sum of $27,141.77, with the additional sum of $5,156.81 as accrued interest, at the rate of 6 per cent, per an-num from February 10, 1931, against appellants, Charles E. Fenner, A. C. Beane, and eight other individuals, composing a partnership, doing á brokerage business under the firm name of Fenner & Beane, and appellants have duly perfected an appeal to this court.
