On November S, 1935, the plaintiff and defendant herein entered into a contract executed in authentic form before a Notary Public, covering the sale of a large number of shares of the capital stock of Suburban Public Service, Inc. The sale was by the plaintiff to the defendant for 3,021 shares of the said stock for the price and sum of $1,430, of which amount the defendant paid the sum of $630 in cash and for the balance of $800 executed his promissory note for that sum payable on or before one year after date and conditioned to bear interest at the rate of eight per cent per…
