The plaintiff in error was tried and convicted at the May, 1911, term of the district court of Kiowa county on a charge of statutory rape, and his punishment fixed at imprisonment in the state penitentiary for a period of five years.
A statement of the facts proved is not necessary for the determination of the principal issues raised in this court.
