This is an action of ejectment, begun on January 27,, 1893, by Miranda Tamplin, the widow, and John Tamplin and others, the children and heirs of one Benjamin Tamplin, deceased, who died on December 8,1892, against the appellant company to recover the possession of a strip of ground from ten to fifteen feet wide next to and outside of a fence, built by the Tamplins to separate from the railroads the portion of lots 9, 10, 11, 12 and 13 in block 1, Lower Peoria, occupied by them.
