This suit is brought upon tbe copyright of a book entitled “The Life of James A. Garfield,” written by James It. Gilmore under the name of Edmund Kirke, against infringement by a book entitled “From Canal-Boy to President,” written by the defendant Alger, and published by tbe defendant Anderson. Since the bearing the defendants have moved to reopen the case for newly-discovered evidence to show that Gilmore cwas not designated by Gen. Garfield as bis special biographer.
