Diamond Parking, Inc., brought this action for declaratory judgment against Martin Theaters of Georgia, Inc., and Sterling Recreation Organization Company, Martin's successor in interest to a commercial ground lease, seeking construction of a rental adjustment provision in that lease. In a trial to the court, sitting without a jury, judgment was entered in favor of Diamond, the court appointing a third appraiser to assist in determining the fair rental value of the property.
