This matter comes up on petitibn of the relator, John Costea, for a writ .of habeas corpus and tbe return to the writ.

Petitioner, an alien, seeks relief from his detention under a deportation warrant of tbe Secretary of Labpr charging (1) that he entered the United States in violation of the Passport Law (Act May 22, 1918, § 1, 22 USCA § 223), and its extension (Act March 2,1921, § 1, 22 USCA § 227), and the President’s proclamation thereunder, and, that he did not have a properly visaed passport; and (2) that he entered in violation of the Quota Act of 1921 (Act May…
