Plaintiff Ronald E. Peck (“Peck” or “plaintiff’) brought this suit against defendant SELEX Systems Integration, Inc. (“SELEX”) in D.C. Superior Court, alleging three contract claims arising from plaintiffs employment termination. SE-LEX removed the case to this Court on January 17, 2013 on the grounds that Count IPs claim for plaintiffs accrued Plan benefit, pled in the original complaint as a common law breach of contract claim, arose under ERISA.
