The' appellant is a licensed hotel runner and has been convicted of a violation of section 925-a of the Penal Law which provides that

“ A person who for purpose of gain and by means of any false statement or representation regarding a hotel, boarding house, *682rooming-house, or lodging house, shall divert or attempt to divert any traveler or other person to another hotel, boarding house, rooming-house or lodging house, shall be guilty of a misdemeanor.
