This is an action for a declaratory judgment and damages brought by plaintiff Joe McGinniss (“McGinniss”). McGinniss seeks a declaration that defendant Employers Reinsurance Corporation (“Employers”) is obligated by a contract of insurance entered into by McGinniss’ publisher, G.P.
