Plaintiff in error, with five named defendants, among whom was one\Henry E. Sorlien, was indicted in the District Court of the United States for the District of Minnesota at the April term thereof, 1923. The indictment returned contained two counts. The first count'charged the defendants, under section 194 of the Penal Code (Comp.
