Appellants Michael Barnett and Barry Jordan were charged, in a three-count indictment, with conspiracy to manufacture and possess with intent to distribute methamphetamine in violation of 21 U.S.C. § 846, possession with intent to distribute methamphetamine in violation of 21 U.S.C. § 841(a)(1), and possession of a listed chemical in violation of 21 U.S.C. § 841(d)(1). Barnett was convicted on all three counts at trial; Jordan pleaded guilty to all three counts shortly after the commencement of trial.
