Hutchison, J.:

This is an action by the Kansas Wheat Growers Association against J. E. Smith, one of its members, originally to enjoin the defendant from selling any of the wheat grown by him to any other dealer during the life of the contract, to recover from him 25 cents per bushel for all wheat sold by him to other dealers, and for costs and attorney fee. The answer admitted the execution of the contract attached to the petition, but denied all other allegations of the petition.
