MEMORANDUM OPINION
COOPER, District Judge.
This matter comes before the Court on the motion of plaintiffs Phyllis Penn and Kenneth Penn (“plaintiffs”) to remand the above-captioned case to the Superior Court of New Jersey, Law Division, Ocean County (“Superior Court of New Jersey”). The defendant Wal-Mart Stores, Inc. (“Wal-Mart”) earlier filed a Notice to remove this case from the Superior Court of New Jersey to this Court.
