Under the provisions of the act of 1905 (Comp. St. 1905, ch. 78, secs.-83-85p) the county board of Lancaster county *683on April 26,1906, entered into a contract with one Charles G-. Sheeley for the construction of all bridges that might be required to be built in said county within the period of one year from that date. After the completion of a large number of bridges under this contract the county board, on the 5th day of January, 1907, entered upon the record of its proceedings of that day that the contract in question “is hereby canceled by mutual consent,” and on the same day…
