WOODS, Circuit Judge.
The declaration alleges in substance that on January 1,1860, the defendant became a stockholder in the Merchants and Planters’ Bank of Savannah, being the owner and holder of 100 shares in the bank, and that he still owns and holds the same. That by an act of the legislature of Georgia, dated February 13, 1854, said bank was incorporated as such.
