This cause comes before the Court upon Defendant American Express Bank, FSB’s (“Defendant”) Motion to Dismiss Plaintiff Industrial Park Development Corporation’s (“Plaintiff’) Amended Complaint, filed on February 26, 2013 (“Motion to Dismiss”) (Doc. 36). On March 12, 2013, Plaintiff filed a Memorandum in opposition (“Opposition”) (Doc. 45). On May 16, 2013, the Court held a hearing on Defendant’s Motion to Dismiss. See Doc. 58.
