Appeal from a judgment of the County Court of Schenectady County (Giardino, J.), rendered February 4, 2004, upon a verdict convicting defendant of the crime of tampering with physical evidence.

At around 1:00 a.m. on November 30, 2002, defendant was involved in an altercation in his home in the City of Schenectady, Schenectady County, with a woman he knew for several years.
