The United States appeals from an order of the United States District Court for the Southern District of New York (Kap-lan, J.), dismissing an indictment against thirteen former partners and employees of the accounting firm KPMG, LLP. Judge Kaplan found that, absent pressure from the government, KPMG would have paid defendants’ legal fees and expenses without regard to cost.
