This action was brought in the name of a married woman, who is the defendant in error, against the executors of the testator, for services which she alleges she rendered to him during an illness of his. The facts as they appeared in the case demonstrate clearly that the contract for such services, which were the care, attendance upon, and the nursing of the testator, was made with the husband of the defendant in error.
