In this action the plaintiff sought to recover damages for injuries inflicted upon his son, a boy of tender years, by negligence of the defendant corporation, as alleged. The injury complained of was done in North Carolina, County of Henderson, at a turn-table of defendant. The defence, 1st, denied the negligence, and, 2nd, relied on contributory negligence on the part of the child. The verdict was for the defendant, and the plaintiff has appealed upon thirty exceptions.
