Appellant pled guilty at a general court-martial to two specifications of indecent acts with a child under 16 years of age, in violation of Article 134, Uniform Code of Military Justice (UCMJ), 10 U.S.C. § 934. The military judge sentenced him to be confined for 9 months, to forfeit all pay and allowances, and to be dismissed from the Naval Service. The convening authority approved the sentence but, in accordance with the pretrial agreement, suspended confinement in excess of 6 months.
