It is alleged that on October 10, 1999, Mujahideen Muhammed (hereinafter, defendant) intentionally killed Julio *592Gonzalez in the course of an attempted robbery. By Kings County indictment number 8393/99, defendant has been charged with murder in the first degree, murder in the second degree (three counts), attempted robbery in the first degree (two counts), criminal possession of a weapon in the second degree, and criminal possession of a weapon in the third degree.
