This case was heard and affirmed by a panel of the Court of Appeals composed of Judge Corwin C. Spencer, Judge Sherman A. Parks, and District Judge Harry G. Miller, retired. The opinion, written by Judge Miller, was unpublished. We granted review and now find that we agree with the resolution of the case by the Court of Appeals.
