MAUGHAN, Justice:

This appeal is from an order of the District Court denying defendant’s motions for a judgment notwithstanding the verdict and for a new trial. Following a jury verdict in favor of the plaintiff, Doris G. Terry, for malicious prosecution, false arrest and false imprisonment, the defendant, Zions Cooperative Mercantile Institution (hereinafter “Z.C.M.I.”), requested a judgment notwithstanding the verdict or in the alternative for a new trial or a remittitur of the damages.
