In form this is a proceeding pursuant to SCPA 1809 brought by the executor of the last will and testament of Paul Imp, deceased, for the determination of a claim which had been filed against said estate by the administrator of the estate of Celia K. Bates in the amount of $45,000, which claim had been rejected.
