OPINION

FRANCIS J. BOYLE, Chief Judge.

This action is a Petition for a Writ of Habeas Corpus under the provisions of 28 U.S.C. § 2254, in which the Petitioner seeks a declaration that he is eligible for parole consideration by the State of Rhode Island.

Petitioner was sentenced on September 14, 1970 to two consecutive life sentences and an additional consecutive ten year sentence following conviction on two counts of murder and one count of conspiracy to murder.
