The Missouri-Kansas-Texas Railroad Company, a corporation, appeals from a judgment for $52,500 recovered by Mary Y. Carver, Administratrix of the estate of Jake Carver, deceased, in an action under the Federal Employers’ Liability Act (45 U. S. C. A. § 51 et seq.) for the wrongful death of Jake Carver, her husband. Defendant questions the submissibility of plaintiff’s ease, the admissibility of certain evidence, the giving and refusing of instructions, and contends the damages are excessive.
