Appeal from the Circuit Court of Cook county; the Hon. Elbridge Hanecy, Judge, presiding. One Thomas Ronan in 1865 became the owner of the west half of lot 10, block 4, in school section addition to the city of Chicago, and resided thereon from thence forward until his death, which occurred in 1888. On the 25th day of April, 1882, said Ronan conveyed said property to one Thomas Carbine.

The cause having been referred to the master to take and report the proofs and his conclusions on points of law and fact, the proofs taken by the master should have been submitted with his report. But whether the omission is a fatal error depends upon whether an inspection of the evidence by the court was necessary in order to determine as to the exceptions to the report.
