ERWIN, Justice.
On April 24, 1969, a hearing was held before the Commissioner of Economic Development, Frank Murkowski, on the application of Dr. August Oetker Co., a/k/a Oetker Brewing Co., for an industrial incentive tax credit under the provisions of AS 43.26.010. At the hearing testimony was taken in support of and in opposition to the application of Oetker Brewing Co. Based on the testimony presented at the hearing, Commissioner Murkowski concluded that sufficient evidence had been presented to justify the granting of a tax credit and that Oetker Brewing Co. constituted a business…
